Arbitration and Conciliation Act

The Arbitration and Conciliation Act, 1996 is the principal legislation governing arbitration, conciliation, and the enforcement of arbitral awards in India. Enacted to provide a fair, efficient, and cost-effective alternative to traditional court litigation, the Act promotes the resolution of commercial, civil, and contractual disputes through impartial arbitrators or conciliators. It minimizes judicial intervention, ensures party autonomy, maintains confidentiality throughout the proceedings, and provides legal recognition and enforceability of arbitral awards. The Act has been strengthened through subsequent amendments to align with international best practices, making India a more arbitration-friendly jurisdiction for both domestic and international dispute resolution.
